These Website Terms of Use (“Terms of Use”) govern your access to and use of the Cumberland Crest House Association website (the “Site”). By using the Site, you agree to these Terms of Use. If you do not agree, do not use the Site.

These Terms of Use are separate from (and do not replace) our Booking & Overnight Stay Terms and Subscription & Membership Terms, which apply when you book or purchase services.

1) Intellectual property and limited license

The Site and its content (text, graphics, logos, images, audio, video, and other materials) are owned by or licensed to CCH and are protected by intellectual property laws. Subject to these Terms of Use, you may view and use the Site for your personal, non-commercial use only.

You may not copy, reproduce, republish, distribute, sell, rent, sublicense, publicly display, or create derivative works from Site content without our prior written permission, except as expressly allowed by law.

2) Acceptable use (“you must not”)

You agree not to:

  • use the Site for any unlawful purpose;
  • attempt to gain unauthorized access to the Site, servers, or related systems;
  • interfere with the Site’s security or operation (including by malware, scraping at scale, or denial-of-service attacks);
  • misrepresent your identity or affiliation; or
  • use the Site in a way that infringes the rights of others.

3) Third‑party links, embeds, and tools

The Site may include third-party links or embedded tools (for example, scheduling, payment, maps, video, reCAPTCHA, or other widgets). We do not control third-party sites and are not responsible for their content, availability, security, or privacy practices. Your use of third-party sites and tools is at your own risk and subject to their terms and policies.

You may not use our logos, trademarks, or other artwork for linking without our prior written permission (or a written trademark/license agreement).

7) Reservation of rights; link removal

We reserve the right to request the removal of any link to the Site. Upon request, you agree to promptly remove the link(s). We also reserve the right to modify these Terms of Use at any time.

If you believe a link on our Site is offensive or inappropriate, you may contact us at contact@cumberlandcresthouse.com. We may consider requests to remove links but are not obligated to do so.

Information on the Site is provided for general informational purposes only and is not medical, mental health, or legal advice. The Site is provided “as is” and “as available,” without warranties of any kind, to the fullest extent permitted by law.

We do not warrant that information on the Site is complete, accurate, or up to date, or that the Site will always be available.

9) Limitation of liability

To the fullest extent permitted by law, CCH will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Site. To the extent liability cannot be excluded, liability will be limited to the minimum amount permitted by law.

10) Governing law; venue

These Terms of Use are governed by Arkansas law (without regard to conflict-of-law rules). Any action relating to these Terms of Use will be brought in a court of competent jurisdiction located in Pulaski County, Arkansas, unless otherwise required by law.
