Subscription & Membership Terms

These Subscription & Membership Terms (“Subscription Terms”) apply to recurring memberships/subscriptions sold by Cumberland Crest House Association (“CCH,” “we,” “us,” or “our”), including any monthly remote frequency subscription (daily frequency support) and any recurring membership for EESystem™ services.

By enrolling in a subscription or membership, you agree to these Subscription Terms.

1) Not medical care; results vary

Subscriptions/memberships are wellness-oriented and are not medical or mental health care. CCH and the EESystem™ are not medical providers. We do not diagnose, treat, cure, or prevent any disease.  Any information provided (online, in writing, or verbally) is for general informational purposes only and is not a substitute for professional medical advice, diagnosis, or treatment. Testimonials are not a guarantee of results.

2) One person per subscription; non-transferable

Each subscription/membership is for one individual and is non-transferable, unless explicitly stated in writing by CCH.

3) Automatic renewal and billing authorization

Subscriptions renew automatically at the billing interval shown at checkout (typically monthly) until canceled in accordance with these Subscription Terms. You authorize us (and our payment processor) to charge your selected payment method for recurring charges, including applicable taxes, unless prohibited by law.

4) Scheduling and arrival

Arrive 15 minutes early. Arriving late may shorten your session. If you have not arrived within 15 minutes after your start time, it may be treated as a no-show, and the scheduled hour(s) will be deducted from your available monthly hours, unless we confirm otherwise in writing.

5) Booking and use of credits

Booking is subject to availability. Monthly session credits expire at the end of each billing cycle.  Unused hours/sessions are forfeited and do not roll over to the next month.

If you choose to end a session early, no refund or credit is provided for unused time. Appointment cancellations/reschedules with less than 24 hours’ notice and no-shows result in forfeiture of the scheduled time (the reserved hours are deducted from your monthly hours).

6) How to cancel subscription/membership 

You may cancel at any time before your next renewal date to avoid the next renewal charge. Cancellation stops future renewals and access remains active through the end of your current paid billing cycle. Subscription fees are non-refundable.

To avoid the next renewal charge, cancel at least 48 hours before your renewal date/time. If we receive a request closer to renewal, your subscription may renew one additional time, and the cancellation will take effect for the following billing cycle.”

Cancel online through your Client Portal/Subscription Management link (preferred), or email contact@cumberlandcresthouse.com from the email on your account with the subject line Cancel Subscription.

7) Refunds

Subscription fees are non-refundable. Cancellation stops future renewals; it does not refund amounts already paid.

8) Failed payments

If a payment fails, we may retry the payment method, pause benefits/service access, or cancel the subscription after notice, to the extent permitted by law.

9) Payments, processors, and disputes

Payments may be collected through our scheduling/CRM platform and processed by third-party payment processors (such as Stripe). We do not store full card numbers. If you have a billing concern, please contact us first so we can work to resolve it. If a chargeback/dispute is filed, we may provide documentation of your booking, attendance, and acceptance of these Terms to the processor and/or your financial institution.

10) Conduct and safety

You agree to behave respectfully toward staff and other guests. We may refuse service or remove anyone whose behavior is disruptive, unsafe, threatening, or inappropriate. For shared spaces, please follow posted etiquette and any guidelines regarding phone/electronic use, noise, scents, and cleanliness.

11) Assumption of risk; limitation of liability

You voluntarily participate in services and assume all risks associated with your participation. To the fullest extent permitted by law, CCH disclaims all warranties (express or implied) regarding the Services, and CCH will not be liable for indirect, incidental, special, consequential, or punitive damages. Any liability, if found, will be limited to the amount you paid for the specific service giving rise to the claim, to the extent allowed by law.

12) Governing law; venue

These Terms are governed by Arkansas law (without regard to conflict-of-law rules). Any action relating to these Terms will be brought in a court of competent jurisdiction located in Pulaski County, Arkansas, unless otherwise required by law.
